A To understand more about the earth’s history, humans have often looked to the natural environment for insight into the past. The bristlecone pine (Pinus longaeva), of the White Mountains in California, has served this purpose greater than any other species of tree on the planet. Conditions here are brutal: scant precipitation and low average temperatures mean a short growing season, only intensified by ferocious wind and mal-nutritious rocky soil. Nevertheless, bristlecone pines have claimed these barren slopes as their permanent home. Evolving here in this harsh environment, super-adapted and without much competition, bristlecones have earned their seat on the longevity throne by becoming the oldest living trees on the planet. Results of extensive studies on bristlecone pine stands have shown that in fact such environmental limitations are positively associated with the attainment of great age. This intriguing phenomenon will be discussed further on.
B But exactly how old is old? Sprouted before the invention of Egyptian hieroglyphs and long before the teachings of Jesus of Nazareth, Methuselah is the oldest bristlecone alive at roughly 4,700 years. Although specimens of this age do not represent the species’ average, there are 200 trees more than 3,000 years old, and two dozen more than 4,000. Considering that these high ages are obtained in the face of such remarkable environmental adversity, the bristlecone pines have become the focus of much scientific examination over the past half-century.
C Perhaps most interested in the bristlecone pine are dendrochronologists or tree-ring daters. With every strenuous year that passes in the White Mountains, each bristlecone grows and forms a new outer layer of cambium that reflects a season’s particular ease or hardship. So while growing seasons may expand or shrink, the trees carry on, their growth rings faithfully recording the bad years alongside the good. Through examining the annual growth rings of both living and dead specimens, taking thousands of core samples, and by processes of cross-dating between trees and other qualitative records, scientists have compiled a continuous tree-ring record that dates back to the last Ice Age between eight and ten thousand years ago. Among other linked accomplishments, this record has enhanced the dating process, helping to double-check and correct the radiocarbon-14 method to more accurately estimate the age of organic material.
D Now more than ever the importance of monitoring the bristlecone is being realized. As our global climate continues to undergo its most recent and abrupt atmospheric change, these ancient scribes continue to respond. Since the rings of wood formed each year reveal the trees’ response to climatic conditions during a particular growing season, in their persistence they have left us natural recordings of the past, markers of the present, and clues to the future.
E The species’ name originates from the appearance of its unusual cones and needles. The bristlecone’s short, pale needles are also trademarks, bunching together to form foxtail-like bundles. As is the case of most conifer needles, these specialized leaves cluster together to shelter the stomata so very little moisture is lost through them. This adaptation helps the bristlecone photosynthesize during particularly brutal months, saving the energy of constant needle replacement and providing a stable supply of chlorophyll. For a plant trying to store so much energy, bristlecone seeds are relatively large in size. They are first reproduced when trees reach ages between thirty and seventy-five years old. Germination rates are generally high, in part because seeds require little to no initial stratification. Perhaps the most intriguing physical characteristic of a mature bristlecone, however, is its ratio of living to deadwood on harsh sites and how this relates to old age. In older trees, especially in individuals over 1,500 years, a strip-bark trait is adaptive. This condition occurs as a result of cambium dieback, which erodes and thereby exposes certain areas of the bole, leaving only narrow bands of bark intact.
F The technique of cambial edge retreat has helped promote old age in bristlecone pine, but that certainly is not the only reason. Most crucial to these trees’ longevity is their compact size and slow rates of growth. By remaining in most cases under ten metres tall, bristlecones stay close to the limited water supply and can hence support more branches and photosynthesizing. Combined with the dry, windy, and often freezing mountain air, slow growth guarantees the bristlecones tight, fibrous rings with a high resin content and structural strength. The absence of natural disaster has also safeguarded the bristlecone’s lengthy lifespan. Due to a lack of ground cover vegetation and an evenly spaced layout, bristlecone stands on the White Mountain peaks have been practically unaffected by fire. This lack of vegetation also means a lack of competition for the bristlecones.
G Bristlecone pines are restricted to numerous, rather isolated stands at higher altitudes in the southwestern United States. Stands occur from the Rocky Mountains, through the Colorado Plateau, to the western margin of the Great Basin. Within this natural range, the oldest and most widely researched stands of bristlecones occur in California’s White Mountains. Even just 200 miles away from the Pacific Ocean, the White Mountains are home to one of this country’s few high-elevation deserts. Located in the extreme eastern rain shadow of the Sierra Nevada, this region receives only 12.54 inches of precipitation per year and experiences temperatures between -20F and +50F. The peaks south of the Owens Valley are higher up than they might appear from a distance. Although most summits exist somewhere around 11,000 feet, snow-capped White Mountain Peak, for which the range is named, stands at 14,246 feet above sea level. That said, to reach areas of pure bristlecone is an intense journey all to itself.
H With seemingly endless areas of wonder and interest, the bristlecone pines have become subject to much research over the past half-century. Since the annual growth of these ancient organisms directly reflects the climatic conditions of a particular time period, bristlecones are of greatest significance to dendrochronologists or tree-ring specialists. Dating any tree is simple and can be done within reasonable accuracy just by counting out the rings made each year by the plant’s natural means of growth. By carefully compiling a nearly 10,000-year-old bristlecone pine record, these patient scientists have accurately corrected the carbon-14 dating method and estimated ages of past periods of global climate change. What makes this record so special to dendrochronologists, too, is that nowhere, throughout time, is precisely the same long-term sequence of wide and narrow rings repeated, because year-to-year variations in climate are never exactly the same.
I Historically the bristlecone’s remote location and gnarled wood have deterred commercial extraction, but nothing on earth will go unaffected by global warming. If temperatures rise by only 6 degrees F, which many experts say is likely this century, about two-thirds of the bristlecones’ ideal habitat in the White Mountains effectively will be gone. Almost 30,000 acres of National Forest now preserves the ancient bristlecone, but paved roads, campsites, and self-guided trails have led only to more human impact. In 1966, the U.S.F.S reported over 20,000 visitors to the Ancient Bristlecone Pine Forest, a figure which could exceed 40,000 today. Over the past hundreds of thousands of years, this species has endured in one of the earth’s most trying environments; they deserve our respect and reverence. As global climate change slowly alters their environment, we as humans must do our part to raise awareness and lower our impact.

A The law influences all of us virtually all the time, it governs almost all aspects of our behaviour, and even what happens to us when we are no longer alive. It affects us from the embryo onwards. It governs the air we breathe, the food and drink we consume, our travel, family relationships, and our property. It applies at the bottom of the ocean and in space. Each time we examine a label on a food product, engage in work as an employee or employer, travel on the roads, go to school to learn or to teach, stay in a hotel, borrow a library book, create or dissolve a commercial company, play sports, or engage the services of someone for anything from plumbing a sink to planning a city, we are in the world of law.
B Law has also become much more widely recognised as the standard by which behaviour needs to be judged. A very telling development in recent history is the way in which the idea of law has permeated all parts of social life. The universal standard of whether something is socially tolerated is progressively becoming whether it is legal, rather than something that has always been considered acceptable. In earlier times, most people were illiterate. Today, by contrast, a vast number of people can read, and it is becoming easier for people to take an interest in law, and for the general population to help actually shape the law in many countries. However, law is a versatile instrument that can be used equally well for the improvement or the degradation of humanity.
C This, of course, puts law in a very significant position. In our rapidly developing world, all sorts of skills and knowledge are valuable. Those people, for example, with knowledge of computers, the internet, and communications technology are relied upon by the rest of us. There is now someone with IT skills or an IT help desk in every UK school, every company, every hospital, every local and central government office. Without their knowledge, many parts of commercial and social life today would seize up in minutes. But legal understanding is just as vital and as universally needed. The American comedian Jerry Seinfeld put it like this, ‘We are all throwing the dice, playing the game, moving our pieces around the board, but if there is a problem, the lawyer is the only person who has read the inside of the top of the box.’ In other words, the lawyer is the only person who has read and made sense of the rules.
D The number of laws has never been greater. In the UK alone, about 35 new Acts of Parliament are produced every year, thereby delivering thousands of new rules. The legislative output of the British Parliament has more than doubled in recent times from 1,100 pages a year in the early 1970s, to over 2,500 pages a year today. Between 1997 and 2006, the legislature passed 365 Acts of Parliament and more than 32,000 legally binding statutory instruments. In a system with so much law, lawyers do a great deal not just to vindicate the rights of citizens and organizations but also to help develop the law through legal arguments, some of which are adapted by judges to become laws. Law courts can and do produce new law and revise old law, but they do so having heard the arguments of lawyers.
E However, despite their important role in developing the rules, lawyers are not universally admired. Anti-lawyer jokes have a long history going back to the ancient Greeks. More recently the son of a famous Hollywood actor was asked at his junior school what his father did for a living, to which he replied, ‘My daddy is a movie actor, and sometimes he plays the good guy, and sometimes he plays the lawyer.’ For balance, though, it is worth remembering that there are and have been many heroic and revered lawyers such as the Roman philosopher and politician Cicero and Mahatma Gandhi, the Indian campaigner for independence.
F People sometimes make comments that characterise lawyers as professionals whose concerns put personal reward above truth, or who gain financially from misfortune. There are undoubtedly lawyers that would fit that bill, just as there are some scientists, journalists and others in that category. But, in general, it is no more just to say that lawyers are bad because they make a living from people’s problems than it is to make the same accusation in respect of nurses or IT consultants. A great many lawyers are involved in public law work, such as that involving civil liberties, housing and other issues. Such work is not lavishly remunerated and the quality of the service provided by these lawyers relies on considerable professional dedication. Moreover, much legal work has nothing to do with conflict or misfortune, but is primarily concerned with drafting documents. Another source of social disaffection for lawyers, and disaffection for the law, is a limited public understanding of how law works and how it could be changed. Greater clarity about these issues, maybe as a result of better public relations, would reduce many aspects of public dissatisfaction with the law.

Lawyers as professionals
People sometimes say that 22 is of little interest to lawyers, who are more concerned with making money. This may well be the case with some individuals, in the same way that some 23 or scientific experts may also be driven purely by financial greed. A It’s not every scientist who writes books for people who can’t read. And how many scientists want their books to look as dog-eared as possible? But Patricia Shanley, an ethnobotanist, wanted to give something back. After the poorest people of the Amazon allowed her to study their land and its ecology, she turned her research findings into a picture book that tells the local people how to get a good return on their trees without succumbing to the lure of a quick buck from a logging company. It has proved a big success.
B The book is called Fruit Trees and Useful Plants in the Lives of Amazonians, but is better known simply as the "fruit book". The second edition was produced at the request of politicians in western Amazonia. Its blend of hard science and local knowledge on the use and trade of 35 native forest species has been so well received (and well used) that no less a dignitary than Brazil’s environment minister, Marina Silva, has written the foreword. "There is nothing else like the Shanley book," says Adalberto Verrísimo, director of the Institute of People and the Environment of the Amazon. "It gives science back to the poor, to the people who really need it."
C Shanley’s work on the book began a decade ago, with a plea for help from the Rural Workers’ Union of Paragominas, a Brazilian town whose prosperity is based on exploitation of timber. The union realised that logging companies would soon be knocking on the doors of the caboclos, peasant farmers living on the Rio Capim, an Amazon tributary in the Brazilian state of Pará. Isolated and illiterate, the caboclos would have little concept of the true value of their trees; communities downstream had already sold off large blocks of forest for a pittance. "What they wanted to know was how valuable the forests were," recalls Shanley, then a researcher in the area for the Massachusetts-based Woods Hole Research Centre.
D The Rural Workers’ Union wanted to know whether harvesting wild fruits would make economic sense in the Rio Capim. "There was a lot of interest in trading non-timber forest products (NTFPs)," Shanley says. At the time, environmental groups and green-minded businesses were promoting the idea. This was the view presented in a seminal paper, Valuation of an Amazonian Rainforest, published in Nature in 1989. The researchers had calculated that revenues from the sale of fruits could far exceed those from a one-off sale of trees to loggers. "The union was keen to discover whether it made more sense conserving the forest for subsistence use and the possible sale of fruit, game and medicinal plants, than selling trees for timber," says Shanley. Whether it would work for the caboclos was far from clear.
E Although Shanley had been invited to work in the Rio Capim, some caboclos were suspicious. "When Patricia asked if she could study my forest," says Joao Fernando Moreira Brito, "my neighbours said she was a foreigner who’d come to rob me of my trees." In the end, Moreira Brito, or Mangueira as he is known, welcomed Shanley and worked on her study. His land, an hour’s walk from the Rio Capim, is almost entirely covered with primary forest. A study of this and other tracts of forest selected by the communities enabled Shanley to identify three trees, found throughout the Amazon, whose fruit was much favoured by the caboclos: bacuri (Platonia insignis), uxi (Endopleura uchi) and piquia (Cayocas villosum). The caboclos used their fruits, extracted oils, and knew what sort of wildlife they attracted. But, in the face of aggressive tactics from the logging companies, they had no measure of the trees’ financial worth. The only way to find out, Shanley decided, was to start from scratch with a scientific study. "From a scientific point of view, hardly anything was known about these trees," she says. But six years of field research yielded a mass of data on their flowering and fruiting behaviour. During 1993 and 1994, 30 families weighed everything they used from the forest -- game, fruit, fibre, medicinal plants -- and documented its source.
F After three logging sales and a major fire in 1997, the researchers were also able to study the ecosystem’s reaction to logging and disturbance. They carried out a similar, though less exhaustive, study in 1999, this time with 15 families. The changes were striking. Average annual household consumption of forest fruit had fallen from 89 to 28 kilogrammes between 1993 and 1999. "What we found," says Shanley, "was that fruit collection could coexist with a certain amount of logging, but after the forest fire, it dropped dramatically." Over the same period, fibre use also dropped from around 20 to 4 kilogrammes. The fire and logging also changed the nature of the caboclo diet. In 1993 most households ate game two or three times a month. By 1999 some were fortunate if they ate game more than two or three times a year.
G The loss of certain species of tree was especially significant. Shanley’s team persuaded local hunters to weigh their catch, noting the trees under which the animals were caught. Over the year, they trapped five species of game averaging 232 kilogrammes under piquia trees. Under copaiba, they caught just two species averaging 63 kilogrammes; and under uxi, four species weighing 38 kilogrammes. At last, the team was getting a handle on which trees were worth keeping, and which could reasonably be sold. "This showed that selling piquia trees to loggers for a few dollars made little sense," explains Shanley. "Their local value lies in providing a prized fruit, as well as flowers which attract more game than any other species."
H As a result of these studies, Shanley had to tell the Rural Workers’ Union of Paragominas that the Nature thesis could not be applied wholesale to their community -- harvesting NTFPs would not always yield more than timber sales. Fruiting patterns of trees such as uxi were unpredictable, for example. In 1994, one household collected 3,654 uxi fruits; the following year, none at all.
I This is not to say that wild fruit trees were unimportant. On the contrary, argues Shanley, they are critical for subsistence, something that is often ignored in much of the current research on NTFPs, which tends to focus on their commercial potential. Geography was another factor preventing the Rio Capim caboclos from establishing a serious trade in wild fruit: villagers in remote areas could not compete with communities collecting NTFPs close to urban markets, although they could sell them to passing river boats.
J But Shanley and her colleagues decided to do more than just report their results to the union. Together with two of her research colleagues, Shanley wrote the fruit book. This, the Bible and a publication on medicinal plants co-authored by Shanley and designed for people with minimal literacy skills are about the only books you will see along this stretch of the Rio Capim. The first print ran to only 3,000 copies, but the fruit book has been remarkably influential, and is used by colleges, peasant unions, industries and the caboclos themselves. Its success is largely due to the fact that people with poor literacy skills can understand much of the information it contains about the non-timber forest products, thanks to its illustrations, anecdotes, stories and songs. "The book doesn’t tell people what to do," says Shanley, "but it does provide them with choices." The caboclos who have used the book now have a much better understanding of which trees to sell to the loggers, and which to protect.
